1. Acceptance of Terms

By accessing or using Wixma ("Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Wixma, operating under Austrian law. If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Wixma provides AI-powered tools for image and video generation, editing, and enhancement. The Service uses third-party AI models (including but not limited to Google Gemini, OpenAI, and Fal.ai) to process your inputs.

3. User Accounts

  • You must be at least 18 years old to use the Service.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • We reserve the right to terminate accounts that violate these Terms.

4. Credits & Payments

The Service operates on a credit-based system.

  • Purchase: Credits can be purchased via one-time packs or monthly subscriptions processed by Stripe.
  • No Refunds: Due to the nature of digital goods and immediate consumption of computing resources, all purchases are final and non-refundable, except where required by Austrian consumer protection law.
  • Expiration: Free credits do not roll over. Purchased credits abide by the terms displayed at checkout.
  • Changes: We reserve the right to change pricing and credit costs at any time.

5. Intellectual Property & Content Rights

  • Your Input: You retain ownership of the images and text you upload. You grant us a license to process these inputs solely to provide the Service.
  • Generated Content: Subject to full payment, Wixma assigns to you all rights, title, and interest in the content you generate using the Service for both personal and commercial use.
  • Disclaimer: AI-generated content may not be copyrightable in certain jurisdictions. You are responsible for verifying the legal status of your creations.

6. Acceptable Use Policy

You agree NOT to use the Service to generate:

  • Child Sexual Abuse Material (CSAM) - We report all instances to authorities immediately.
  • Non-consensual sexual content (deepfakes).
  • Hate speech, harassment, or content promoting violence.
  • Illegal acts or misleading political content.

Violation of this policy will result in immediate ban without refund.

7. Limitation of Liability

To the maximum extent permitted by Austrian law, Wixma shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. The Service is provided "AS IS" without warranties of any kind. We do not guarantee that the AI generation will meet your specific expectations or be error-free.

8. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Austria, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in Vienna, Austria.
